The clients (the “Purchaser”) fully understand that the said token represents no form or qualification of security. The token is final and not refundable. Any individual practice the sale or purchase of token expressly acknowledge and represent that he/it has a full review and is willing able to take on the risks, cost, and benefits associated with the cryptocurrencies in the Terms.
Prior to any use of the CoinMakes Token (CoinMakes.com), the user confirms to understand and expressly agrees to all of the Terms. All capitalized terms in this agreement will be given the same effect and meaning as in the Terms. The group of developers and other personnel that is now, or will be, employed by, or contracted with, MARGIN LTD. has termed the “CoinMakes Team” The Token will be developed by persons and entities who support MARGIN LTD.., including both volunteers and developers who are paid by nonprofit entities interested in supporting the CoinMargin Exchange and the CoinMakes Token. By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as 'User Agreement'), along with the terms and conditions as stated in our Privacy Policy given in the website.

a) Purchase or engagement of service which is not compliance with the term of the contract
b) Non-performance, failure, malfunction or unavailability of the service due to the third party, the Client, a third-party product, or the Client’s breach of its obligations
c) Loss, alteration, or destruction of all or part of the content (information, data, application, files, or other items) hosted on the infrastructure, insofar as MARGIN LTD. (COINMAKES.COM) is not responsible for managing the continuity of client activities and data backup in particular
d) Suspension of access either temporary or permanent of services in conjunction of request issued by administrative or judicial authority received from the third party
e) A mismatch between the services and the client’s ( in particular, with regard to the sensitivity of the relevant data)
f) Loss, disclosure, unlawful or fraudulent use of user sign-on by clients or third parties
g) Indirect damage such as business loss or disturbance, loss of orders, operating loss, infringement of the trademark, loss of profits or clients (e.g. improper disclosure of confidential information concerning said clients due to failure or piracy of the system, third- party proceedings against the Client, etc
Acquiring COINMAKES Token involves various risks. Therefore, and prior to acquiring COINMAKES Token, any interesting person should carefully consider the risks, costs, and benefits of acquiring COINMAKES Token on the CoinMargin Exchange or any trading platform where it is listed, or through a peer to peer transactional activity, and, if necessary, obtain any independent advice in this regard. Any interesting person is not in the position to accept nor to understand the risks associated with the Token Purchase (incl. the risks related to the non- development of COINMAKES network and operations) or any other risks as indicated in the Terms, should not acquire COINMAKES Token, at this stage or even later.
An Individual purchasing or dealing in COINMAKES Token must be aware that MARGIN LTD. and CoinMargin business model and ecosystem and the Terms may change or need to be modified due to new regulations and compliance requirements from any applicable laws in any jurisdictions. In such case, Purchasers, Traders or Holders and any other undertaking in the MARGIN LTD. acknowledge and understand that neither MARGIN LTD. nor its affiliate shall be held liable for any direct and indirect loss or damage caused by such change
3.1. By registering to purchase CoinMakes Token or creating any of its wallets and aiming to access the CoinMakes Token, you affirm that you are at least 18 years old and are an individual, legal person or other organization with the full legal capacity to enter into this User Agreement between you and MARGIN LTD.. (CoinMakes.com). If you are not, please discontinue use of the Service or access of the wallet and the token. You need to pass the KYC check before opening a wallet account and making your first withdrawal. In addition, MARGIN LTD. (CoinMakes.com) shall have the right to close or lock your account in addition to filing claims against you and/or your legal guardian for damages related to your use of the CoinMakes Token (CoinMakes.com)
4.1. By using or purchasing CoinMakes Tokens and any of the Services, you acknowledge and affirm that you are not on any trade or economic sanctions lists, such as the United Nations Security Council Sanctions List and its equivalent. MARGIN LTD. (CoinMakes.com) maintains the right to select its markets and jurisdictions to operate and may restrict or deny its services to certain countries. The content of this User Agreement shall not be excluded from the laws of the country under which the user belongs. MARGIN LTD. (CoinMakes.com) demands that any users not in full compliance with this User Agreement refrain from accessing the CoinMakes Token (CoinMakes.com) and/or using any of the Services.
5.1. CoinMakes Token (CoinMakes.com) acts as the native token of the CoinMargin Platform which provides a platform for online peer-to-peer digital asset trading (crypto to crypto) for electronic currency such as digital tokens, cryptographic tokens or cryptographic currency.
5.2. CoinMakes Token acts as the native trading pair of the CoinMargin platform, allowing users/traders to trade other cryptocurrencies on the platform using the CoinMakes Token as base asset.
5.3. MARGIN LTD. (CoinMakes.com) endeavors to ensure the accuracy of information posted on its website; however, it cannot and does not guarantee the accuracy, suitability, reliability, completeness, performance or fitness for any particular purpose of the content on the website, and will not accept liability for any damage or loss that may result directly or indirectly from such content.

5.5. By using CoinMakes Tokens and any of the Services, you affirm that all information provided to CoinMakes Token (CoinMakes.com) in connection with this User Agreement is true, accurate, and complete.
6.1. By registering an account on the CoinMakes Wallet, you agree to share personal information requested for the purposes of identity verification. Such information shall be used for the detection of money laundering, terrorist financing, fraud, and other financial crimes on the MARGIN LTD. (CoinMakes.com) platform. In addition to providing this information, to ensure compliance with global industry standards for data retention, you agree that we may retain such information for the lifetime of your account plus five years beyond the date your account is closed. You also authorize us to make inquiries, either directly or through third parties, that MARGIN LTD. (CoinMakes.com) may deem required to verify your identity or to protect you and/or us against financial crimes such as fraud

After registration, you must covenant that information shall remain truthful, complete, and updated in a timely manner with any changes. shall have the right to send you a notice to demand corrections, remove relevant information directly and, as the case may be, terminate all or part of CoinMakes Inc. (CoinMakes.com) Service to you. You shall be solely and completely responsible for any loss or expenses incurred during the use or trade of CoinMakes Tokens if you cannot be contacted through the contact information provided. You hereby acknowledge and agree that you have the obligation to keep all information provided current and accurate.
7.1. Only the person whose name is registered on the MARGIN LTD. (CoinMakes.com) account may use the account. MARGIN LTD. (CoinMakes.com) reserves the right to suspend, freeze or close accounts that are used by persons other than the persons whose names they are registered under. MARGIN LTD. (CoinMakes.com) will not be liable or legally responsible for such accounts.
8.1. MARGIN LTD. (CoinMakes.com) reserves the right to settle issues and disputes in whichever manner and forum it deems suitable. Some issues include infringement of others’ rights, violation of laws and regulations, abnormal trades, and other issues not explicitly mentioned in this User Agreement. Users agree to bear the costs arising from the process of dispute resolution.
9.1. You hereby agree to observe the following covenants during your use of the Services on MARGIN LTD. (CoinMakes.com):
9.1.1. All the activities that you perform during the use of the Services will be in compliance with the requirements of applicable laws, regulations, as well as the guidelines of MARGIN LTD. (CoinMakes.com),
9.1.2. will not be in violation of public interests, public ethics or others’ legitimate interests,
9.1.3. will not be used to evade lawful taxes or fees and will not violate this User Agreement or relevant rules.
9.2. If you violate the foregoing covenants, you shall solely assume all of the legal consequences related to such violation and shall indemnify MARGIN LTD. from all actions, claims, or costs arising from such violation. You will not use any data or information displayed on the website for commercial purposes without the prior written consent of MARGIN LTD. (CoinMakes.com). You shall use the site in accordance with this User Agreement, and shall refrain from any acts of unfair competition or any actions that may interfere with the normal operation of CoinMakes Inc and its token.
9.3. Examples of such prohibited acts include, but are not limited to:

9.3.3. executing malicious sales or purchases on the market

(CoinMakes.com) shall have the right to determine in its sole discretion whether you have violated any of the above covenants and take actions to apply relevant rules without receiving your consent or giving prior notice to you. 9.4.3. reporting the incident to authorities
9.4.4. publishing the alleged violations and actions that have been taken

9.5. If your alleged violation causes any losses to a third party, you shall solely undertake all the legal liabilities in your own name and hold MARGIN LTD. (CoinMakes.com) harmless from any loss, fine or extra expenses. If due to any alleged violation MARGIN LTD. (CoinMakes.com) incurs any losses, is claimed by any third party for compensation or suffers any penalty or other legal consequences imposed by any administrative authorities, you shall indemnify MARGIN LTD. (CoinMakes.com) against any losses and expenses caused thereby, including reasonable attorney’s fees.
10.1. MARGIN LTD. (CoinMakes.com) reserves the right to levy service fees on users who use its services. It is in the sole discretion of MARGIN LTD. (CoinMakes.com) to adjust the service fees charged to users using the Services.
11.1. You acknowledge and agree that MARGIN LTD. (CoinMakes.com) shall not be liable for any losses caused by any of the following events, including but not limited to:
11.1.1. Use or failure to use CoinMakes website or Token
11.1.2. Unauthorized use of your wallet account, exchange account, your CoinMakes Tokens or unauthorized alteration of your data by third parties
11.1.3. Your misunderstanding of CoinMakes Token (CoinMakes.com)
11.1.4. Any other losses related to CoinMakes Token (CoinMakes.com) which are not directly attributable to CoinMakes Token (CoinMakes.com)
11.2. In no event shall MARGIN LTD. (CoinMakes.com) be liable for any failure or delay of service resulting from regular network maintenance or external factors such as power failure, natural disaster, service provider-side problems or governmental acts.
You agree to indemnify and hold harmless MARGIN LTD. (CoinMakes.com), its affiliates, contractors, licensors, and their respective directors, officers, employees and agents from and against any claims and damages (including attorneys’ fees, fines or penalties imposed by any regulatory authority) arising out of your breach or our enforcement of this Agreement. The above- mentioned indemnity shall also apply to any violation of any applicable law, regulation, or rights of any third party during your use of the Services.
The user or MARGIN LTD. websites or token holders is responsible to abide by local laws related to the use of CoinMakes Token (CoinMakes.com) in their local jurisdiction including but not limited to all types of taxation, withholding, collection, reporting, and remittance to their appropriate tax authorities. All users of CoinMakes Token (Coinmakes.com) and any of the services represent and warrant that the source of their funds come from a legitimate manner and are not derived from illegal activities. MARGIN LTD. (Coinmakes.com) actively cooperates with law enforcement authorities globally and will not hesitate to seize, freeze, terminate the account, and funds of users which are flagged out or investigated by legal decree.
You agree to indemnify MARGIN LTD. (Coinmakes.com) and its entirety of affiliates and hold them harmless from and against all third-party claims except MARGIN LTD. (Coinmakes.com) breach of these Terms. As mentioned in the description of services, MARGIN LTD. (Coinmakes.com) tries its best to maintain the data integrity on its site but does not guarantee the information and services provided in its platform. MARGIN LTD. (Coinmakes.com) will not be liable for errors arising from the use of its tokens or services.
